LIMITED WARRANTY FOR THE ELECTRON WHEEL

ELECTRON WARRANTY POLICY

Electron Wheel warrants to the original retail owner of each new Electron Wheel that, subject to the terms and conditions set out below, the Electron Wheel will be free of defects in materials and workmanship when used normally in accordance with the Company’s published guidelines for the period of one (1) year from the date of delivery. This limited warranty does not apply to normal wear and tear, malfunctions, or failures that result from abuse, improper assembly, neglect, alteration, modification, improper repair, improper maintenance, crash, misuse, collision or other improper use.

Diagnostics, labor, materials, tests, and return delivery are covered pursuant to Electron Wheel’s terms and conditions below.

REGISTRATION

Each Electron Wheel must be registered. In order to utilize the product with it’s mobile applications (“Application” or “App”), you are required to register your Electron Wheel to your Electron Wheel account (“Product Registration”). The Product Registration will take place at the time you initially access the mobile App. This Product Registration process is necessary in order to use your Electron Wheel and will be used as evidence of ownership when making a warranty claim.

TERMS OF THE WARRANTY

Each Electron Wheel is warranted to be free from manufacturing defects in materials or workmanship for the period of one (1) year from the date of delivery. After this warranty period has elapsed, Electron Wheel offers paid service options.

Electron Wheel requests that customers are responsible for shipping costs when sending their products in for return, repair, exchange, or for warranty claims. Our technical staff will evaluate the product to identify the issue and determine responsibility. If the issue is a manufacturing defect in the workmanship or materials, Electron Wheel will assume the cost of diagnostics, materials, labor, and return delivery fee. If the product is determined not subject to warranty, Electron Wheel will advise the customer of cost of repair and return shipping prior to beginning any repair or return shipping.

Electron Wheel reserve’s the right to examine the failed product to determine the cause of failure and patterns of usage and to be the sole judge as to whether the Product is defective and covered under this warranty.

In the event of the product or part being replaced, any replacement item becomes your property and the replaced or refunded item becomes our property. The Warranty Period will not be extended or renewed or otherwise affected due to subsequent exchange, resale, repair or replacement of the Product. The part(s) repaired or replaced during the Warranty Period will be warranted for the remainder of the original Warranty Period.

HOW TO MAKE A CLAIM

If you wish to make a warranty claim, please contact us through our website contact form, or via email at support@electronwheel.com for claim instructions. To make a warranty claim, you will need to provide an original proof or purchase AND your Electron Wheel’s serial number. The claim must be made within thirty (30) days of the issue coming to your attention, and before the expiration of the one (1) year warranty period.

We will send you a warranty claim form, and if the claim is approved, we will send you detailed shipping and handling instructions. The owner will be responsible for shipping charges to Electron Wheel, and must follow our shipping instructions carefully. Due to the Electron Wheel’s lithium-ion battery, the product may be considered a dangerous good while in transit and you cannot ship the product for return without following our shipping and handling instructions. The product must always be shipped through ground shipping. Failure to follow these procedures will void the warranty.

We reserve the right to examine the failed product to determine the cause of failure and patterns of usage and to be the sole judge as to whether the product is defective and covered under this warranty.

EXCLUSIONS

Unless agreed to in writing, this limited warranty will not apply if the issue is related to any of the following parameters including, but not limited to:

  1. Normal wear and tear, malfunctions, or failures that result from abuse, improper assembly, neglect, alteration, modification, improper repair, improper maintenance, crash, misuse, collision or other improper use.
  2. Exceeding the maximum suggested weight (rider + bike + load) of 120kg (265lbs).
  3. Using the Electron Wheel for commercial use or in competitive events.
  4. Unauthorized removal of any components, including the battery.
  5. Alteration or modification of the Electron Wheel’s firmware.
  6. Alteration of any kind to the Electron Wheel’s serial number
  7. Any failure to properly transport or ship the Electron Wheel.

SOLE REMEDY

This limited warranty is your sole and exclusive remedy against Electron Wheel and Electron Wheel’s sole and exclusive liability in respect of defects in the product. To the extent permitted by law, this limited warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. Electron Wheel disclaims all statutory and implied warranties, including, but not limited to, warranties of merchantability and fitness for a particular purpose and warranties against hidden and latent defects. Electron Wheel is not liable for any other cost or damages, including lost profits, incidental, special or consequential damages. Some states and jurisdictions do not allow the exclusion of incidental or consequential damages so the above exclusions may not apply. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
